Please read these Terms & Conditions carefully before using the services of Coastal Web Management. By engaging our services, you agree to be bound by these terms. These terms are written in plain English to be clear and fair for all parties. If you have any questions, please contact us before proceeding.
Coastal Web Management may provide website design, website management, website maintenance, website modernization, SEO services, Google Business Profile optimization, digital marketing services, content updates, hosting coordination, domain coordination, consulting, and related online services. The specific services provided to each client will be determined based on the selected plan or agreement.
All services are provided on an at-will basis. Either Coastal Web Management or the client may terminate the business relationship at any time, with or without cause, subject to any outstanding payment obligations. This at-will relationship means that no guaranteed duration of service is implied unless otherwise agreed upon in writing.
Monthly plans are month-to-month and are not long-term contracts unless otherwise agreed in writing. Clients are not locked into extended commitments and may cancel at any time in accordance with the Cancellation Policy outlined below.
By enrolling in a monthly service plan, clients authorize Coastal Web Management to process recurring automatic monthly payments for ongoing services. Recurring charges will continue until canceled by either party. Clients are responsible for maintaining a valid payment method on file and for updating payment information as needed to avoid service interruptions.
Setup fees, onboarding fees, website creation fees, and project fees are generally non-refundable once work has begun. This includes but is not limited to initial website design, development, configuration, and any preparatory work performed on behalf of the client.
Payment is due according to the selected plan or invoice. Failure to pay by the due date may result in suspension or termination of services. Clients are responsible for all fees associated with their selected plan, including any applicable taxes or third-party charges.
Either party may cancel services at any time. To cancel, clients should provide written notice via email to [email protected]. Clients remain responsible for any unpaid balances incurred before the effective date of cancellation. Cancellation does not entitle clients to a refund of any fees already paid.
Clients are responsible for providing accurate information, content, approvals, images, logos, credentials, and other materials necessary for Coastal Web Management to perform services. Delays caused by a client's failure to provide required materials may affect project timelines and deliverables. Coastal Web Management is not responsible for delays resulting from incomplete or inaccurate client-provided information.
Clients are solely responsible for the legality, ownership, accuracy, and intellectual property rights associated with all content they provide to Coastal Web Management. By submitting content, clients represent and warrant that they have the right to use and authorize the use of such content. Coastal Web Management assumes no liability for content provided by clients.
Domain registration, hosting, email services, AI tools, software subscriptions, third-party platforms, search engines, social media platforms, and other external services are controlled by independent third parties. Coastal Web Management cannot guarantee the availability, performance, pricing, uptime, security, or policies of any third-party service. Changes made by third-party providers may affect services provided by Coastal Web Management, and such changes are outside our control.
Coastal Web Management follows industry best practices for search engine optimization. However, we cannot guarantee specific search engine rankings, traffic increases, leads, conversions, sales, indexing timelines, or any particular SEO results. Search engine algorithms are controlled by third parties and are subject to change at any time without notice.
Coastal Web Management cannot guarantee uninterrupted website availability, uptime, security, compatibility with all devices or browsers, or overall website performance. Many factors affecting website performance are outside our direct control, including but not limited to hosting provider issues, third-party integrations, internet infrastructure, and user device configurations.
To the fullest extent permitted by applicable law, Coastal Web Management shall not be liable for any indirect, incidental, consequential, special, exemplary, or lost-profit damages arising from or related to the use of, or inability to use, our services — even if Coastal Web Management has been advised of the possibility of such damages. Our total liability for any claim arising out of or relating to these Terms shall not exceed the total fees paid by the client in the three (3) months preceding the claim.
Services are provided on an "as-is" and "as-available" basis to the fullest extent permitted by law. Coastal Web Management makes no warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
Clients retain ownership of all content, images, logos, and materials they provide to Coastal Web Management. Ownership of website assets, designs, and deliverables created by Coastal Web Management transfers to the client upon receipt of full payment for the applicable project or service, unless otherwise agreed in writing. Coastal Web Management retains the right to display completed work in its portfolio unless the client requests otherwise in writing.
Clients agree to indemnify, defend, and hold harmless Coastal Web Management, its owners, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to client-provided content, materials, instructions, or misuse of services provided by Coastal Web Management.
If a client fails to make a scheduled payment, recurring payment, or invoice payment when due, Coastal Web Management reserves the right to immediately suspend, restrict, disable, remove, or terminate website management services, maintenance services, SEO services, content updates, support services, hosting-related services, and any other ongoing services until all outstanding balances have been paid in full.
Service interruptions caused by non-payment shall not constitute a breach of agreement by Coastal Web Management. Clients remain responsible for all outstanding balances, fees, and charges incurred before cancellation or suspension, regardless of whether services were actively used.
These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Florida.
Coastal Web Management reserves the right to update or modify these Terms & Conditions at any time. Clients will be notified of material changes when reasonably practicable. Continued use of our services following any modifications constitutes acceptance of the updated Terms. We encourage clients to review these Terms periodically.
